Cancellation policy 
1.       Our cancellation policy details: 
• The Client and the Tutor are responsible for notifying one another in advance of any necessary changes to the agreed session. Wherever possible an alternative date will be arranged. 
• ThinkTric operates a 48-hour cancellation policy and reserves the right to charge the Client in full if a lesson/consultation is cancelled at short notice. 

 2.       General terms:

• For any alterations or variations of these Terms and Conditions to be valid, they must first be approved by a Director of ThinkTric.   
• Unless otherwise agreed in writing by a Director, these Terms and Conditions shall prevail over any other Terms of Business or Conditions put forward by the Client.​
•You may not transfer any of your rights under this privacy policy to any other person. We may transfer our rights under this privacy policy where we reasonably believe your rights will not be affected. ​
•If any court or competent authority finds that any provision of this privacy policy (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this privacy policy will not be affected. ​
•Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.​
• This Agreement will be governed by and interpreted according to the law of England and Wales. 

 3. Changes to this privacy policy 
​•ThinkTric reserves the right to change this privacy policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Website and you are deemed to have accepted the terms of the privacy policy on your first use of the Website following the alterations.  

4.       For anyone purchasing services from ThinkTric:  
• Acceptance of our services will be taken to represent agreement to these Terms and Conditions. 

5.       Specifically in regards to the assessments provided by ThinkTric: 
Payment: The full cost of the assessment is payable in three instalments: The first instalment (the deposit) is due at the time of booking and is non-refundable. The second instalment is due no later than 7 days before the assessment appointment – assessments cannot proceed without this second payment. If your appointment is rescheduled due to non-payment you may be subject to charges under our cancellation policy. The third and final instalment is payable upon completion of the Assessment Report. Your report will be sent on receipt of this final payment. 
Cancellation: If you wish to cancel or reschedule your assessment: All changes and cancellations must be notified in writing to contact@thinktric.co.uk Cancellation charges will apply as follows: cancellation within 7 days of a booked session will incur a charge equal to 50% of the deposit paid. cancellation within 48 hours of a booked session will incur a charge of 100% of the deposit paid. In the unlikely event that unforeseen circumstances require us to cancel a booking, we will endeavour to give clients a minimum of 48 hours notice* and to reschedule the assessment. *Please note that it is the client’s responsibility to provide us with an emergency contact number at which they will normally be available. 
Your data: Your final Assessment Report will be held (within your customer record file) by ThinkTric for 7 years. During this time, you will be able to ask for an electronic copy of the report (there will be an administration charge for this). We would, therefore, strongly recommend that you keep a copy of your report securely. After this time, we will not be able to supply you with a copy of your report. Should you require a copy of your assessment report, would like your report to be permanently deleted, or need changes/corrections made to it before this time, please notify us at: contact@thinktric.co.uk Following the assessment and the completion of the final Assessment Report, all client questionnaires, all raw data test sheets and all other personal data will be permanently deleted/destroyed. Where full payment for our services is not received within 28 days of completion of the report, the final Assessment Report will also be destroyed/deleted.

5. We may collect the following Data, which includes personal Data, from you:

a. web browser type and version (automatically collected);
b. operating system (automatically collected);
in each case, in accordance with this privacy policy.

a. data is given to us by you ;

c. data is collected automatically.

7. ThinkTric will collect your Data in a number of ways, for example:
a. when you contact us through the Website, by telephone, post, e-mail or through any other means;
b. when you use our services;
in each case, in accordance with this privacy policy.

8. ThinkTric will receive Data about you from the following third parties:
a. Google and other Main-stream analytics Resources.
Data that is collected automatically
9. To the extent that you access the Website, we will collect your Data automatically, for example:
a. we automatically collect some information about your visit to the Website. This information helps us to make improvements to Website content and navigation, and includes your IP address, the date, times and frequency with which you access the Website and the way you use and interact with its content.

10. Any or all of the above Data may be required by us from time to time in order to provide you with the best possible service and experience when using our Website. Specifically, Data may be used by us for the following reasons:

in each case, in accordance with this privacy policy.
11. We may use your Data for the above purposes if we deem it necessary to do so for our legitimate interests. If you are not satisfied with this, you have the right to object in certain circumstances (see the section headed “Your rights” below).

a. our employees, agents and/or professional advisors – to allow the services for which you have signed up for to be delivered.;

a. access to your account is controlled by a password and a user name that is unique to you.
b. we store your Data on secure servers.

Data retention
16. Unless a longer retention period is required or permitted by law, we will only hold your Data on our systems for the period necessary to fulfil the purposes outlined in this privacy policy or until you request that the Data be deleted.
17. Even if we delete your Data, it may persist on backup or archival media for legal, tax or regulatory purposes.
Your rights
18. You have the following rights in relation to your Data:
a. Right to access – the right to request (i) copies of the information we hold about you at any time, or (ii) that we modify, update or delete such information. f. Right to object – the right to object to our use of your Data including where we use it for our legitimate interests.

Changes of business ownership and control
23. ThinkTric may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of ThinkTric. Data provided by Users will, where it is relevant to any part of our business so transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this privacy policy, be permitted to use the Data for the purposes for which it was originally supplied to us.
